Terms of Service

Acceptance of these terms

These terms govern your use of dybilling.com, operated by DyBilling of 1001 S Main St, Ste 500, Kalispell, MT 59901. By visiting the site, reading its content or submitting a form, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site. These terms apply to the website only. Any billing, revenue cycle, credentialing or other service we perform for a practice is governed by a separate written service agreement and Business Associate Agreement, and where those documents conflict with these terms, the signed documents control.

Use of the website

You may use this website for lawful purposes connected with evaluating or engaging our services. You agree not to submit false information through our forms, not to send protected health information through the website, not to attempt to gain access to any part of the site or its hosting that is not intended for the public, and not to copy or scrape the site's content in bulk. We may block access from any source that we reasonably believe is abusing the site. The site is provided for users in the United States, and we make no representation that its content is appropriate for use elsewhere.

Informational content only

Articles, service descriptions, glossary entries and other content on this website are provided for general information about medical billing and practice administration. They are not legal advice, coding advice or compliance advice, and they do not create a professional relationship between you and DyBilling. Payer rules, CPT and HCPCS codes, modifiers, filing limits and federal and state regulations change frequently and vary by payer and jurisdiction. Before acting on anything you read here, confirm it against the current payer policy or the relevant regulation, or consult a qualified attorney, certified coder or compliance professional who knows your circumstances.

Free billing audit and trial period

Our free billing audit and any trial period we offer are provided without charge and without obligation on your part to engage us afterward. Audit findings are based on the data and access you provide and on our professional judgement at the time. They are estimates, not guarantees, and actual recoveries depend on payer behavior, documentation and filing deadlines outside our control. Any trial work is performed under a signed Business Associate Agreement and a short written trial agreement. If you choose to proceed after the trial, the terms of the engagement, including fees, scope and termination, are set exclusively by the written service agreement we both sign.

Intellectual property

The text, graphics, logos, page layouts and other content on this website belong to DyBilling or are used under license, and are protected by United States copyright and trademark law. You may view, download and print pages for your own internal business use in evaluating our services. You may not republish, redistribute, sell or create derivative works from the content without our written permission. DyBilling and the DyBilling logo are our trademarks. Names of practice management systems, payers and other companies mentioned on the site belong to their respective owners and are used only to describe compatibility or context.

Third-party links and services

This website links to third-party sites such as CMS, HHS, X12, CAQH and payer websites, and uses third-party services including Google Analytics and Web3Forms. We provide links because we believe the sources are useful, but we do not control those sites and are not responsible for their content, accuracy, availability or privacy practices. A link does not mean we endorse the site or that it endorses us. Your use of any third-party site or service is governed by that party's own terms. Cited regulatory sources may be updated or moved after we link to them, so check the current version before relying on it.

Disclaimer of warranties

This website and its content are provided as is and as available. To the fullest extent permitted by law, DyBilling disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that the site or its hosting is free of viruses or other harmful components. We try to keep content current, but we make no warranty that any statement on the site about payer rules, regulations or industry practice is complete or up to date at the time you read it.

Limitation of liability

To the fullest extent permitted by law, DyBilling and its owners, employees and contractors will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of revenue, profits, data or goodwill, arising out of your use of or inability to use this website or your reliance on its content, even if we were advised of the possibility of such damages. Our total liability for any claim relating to the website will not exceed one hundred dollars. This limitation applies to the website only. Liability arising from services we perform for a client is addressed in the service agreement for that engagement.

Governing law

These terms and any dispute arising from your use of the website are governed by the laws of the State of Montana, without regard to its conflict of law rules. You agree that the state and federal courts located in Flathead County, Montana have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction there. If any provision of these terms is found unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. These terms are the complete agreement between you and DyBilling regarding use of the website.

Changes to these terms and how to contact us

We may revise these terms from time to time. The date at the top of this page shows when they were last updated, and changes take effect when posted. If we make a material change we will note it on this page for at least 30 days. Your continued use of the website after a change means you accept the revised terms.
